Keeping Kids Safe: A Look at the Child Safety on Motorcycles Act

Ensuring the safety of children on Philippine roads is a priority, and Republic Act No. 10666, also known as the "Children's Safety on Motorcycles Act of 2015", plays a crucial role in achieving this goal.

The Law's Objectives:

  • Protect children from the dangers of motorcycle riding, especially on busy roads with fast-moving vehicles.
  • Promote responsible motorcycle use by adults carrying children as passengers.

Key Provisions:

  • Restrictions: It's illegal to transport a child on a motorcycle on public roads exceeding 60 kph speed limits or with heavy/fast-moving traffic unless:

    • The child's feet comfortably reach the footpegs.
    • The child's arms can encircle the rider's waist.
    • The child wears a standard helmet as mandated by RA 10054 (Motorcycle Helmet Act).
  • Exceptions: In emergencies requiring immediate medical attention, these restrictions don't apply.

  • Penalties: Violations come with escalating fines:

    • ₱3,000 for the first offense
    • ₱5,000 for the second offense
    • ₱10,000 + 1-month license suspension for the third offense
    • License revocation for subsequent offenses
  • Review of Penalties: The LTO can adjust fines every three years to maintain their effectiveness as deterrents.

  • Increased Penalties in Case of Injuries: If a child or another person is seriously injured or killed due to a violation, the motorcycle rider faces a one-year jail term on top of other potential penalties.

  • Enforcement: The LTO can deputize PNP, MMDA, and LGU personnel to enforce the Act.

  • Public Awareness: The LTO, with partner agencies, is required to conduct a nationwide information campaign to educate the public about the Act's provisions.
